Chibaya bail hearing continues

CITIZENS Coalition for Change (CCC) activist Amos Chibaya’s bail hearing continued yesterday with the State opposing the former opposition lawmaker’s freedom, claiming that he is a flight risk.

Chibaya has been in detention since his arrest last week on charges of inciting anti-government protests.

He is represented by lawyer Chris Mhike.

The State, led by Rufaro Chonzi, alleges that Chibaya was part of CCC activists who staged demonstrations at the Harare Magistrates Court in June this year demanding the release of 77 party activists who had been arrested and denied bail together with their interim leader Jameson Timba.

Chibaya allegedly convened a meeting at the entrance of the Harare Magistrates Court building, where Agency Gumbo and Gift “Ostallos” Siziba were among the speakers.

During the meeting, Chibaya allegedly uttered incitement words which include “Chi regime chinotya vanhu, chikaona vanhu chinobvunda”; Havana kuhwina maelections, togona kufuma tavakutonga; Zimbabwe haisi yeZANU PF; Zimbabwe is not a Mnangagwa dynasty yekumbunyikidza vanhu, zvinofanira kupera.”

It is alleged that he encouraged the people to come in large numbers to force authorities to release their detained colleagues.

According to evidence from the investigating officer in the matter, if granted bail, Chibaya will default court attendance.

The State pressed on saying Chibaya committed a serious crime and that he should be remanded in custody until the matter is finalised.
